Despicable libertarian judge Bernard Friedman appointed by Ronald Reagan dismisses cases against Muslim clit cutters in Detroit

This is the same libertarian, anti-conservative, judge who overturned Michigan's 2004 Marriage Act in 2014. He threw out the cases on the grounds the law passed under the Commerce Clause had nothing to do with commerce because Muslim clit cutting isn't a large market with a measurable impact on commerce. It will have when the country is full of Muslims. What a damn fool.

Why must we still live under the thumb of judges, let alone under those appointed in the 1980s?

 Judge dismisses female genital mutilation charges in historic case:

In a major blow to the federal government, a judge in Detroit has declared America's female genital mutilation law unconstitutional, thereby dismissing the key charges against two Michigan doctors and six others accused of subjecting at least nine minor girls to the cutting procedure in the nation's first FGM case.

The historic case involves minor girls from Michigan, Illinois and Minnesota, including some who cried, screamed and bled during the procedure and one who was given Valium ground in liquid Tylenol to keep her calm, court records show.

The judge's ruling also dismissed charges against three mothers, including two Minnesota women whom prosecutors said tricked their 7 -year-old daughters into thinking they were coming to metro Detroit for a girls' weekend, but instead had their genitals cut at a Livonia clinic as part of a religious procedure.

U.S. District Judge Bernard Friedman concluded that "as despicable as this practice may be," Congress did not have the authority to pass the 22-year-old federal law that criminalizes female genital mutilation, and that FGM is for the states to regulate. FGM is banned worldwide and has been outlawed in more than 30 countries, though the U.S. statute had never been tested before this case. 

"As laudable as the prohibition of a particular type of abuse of girls may be ... federalism concerns deprive Congress of the power to enact this statute," Friedman wrote in his 28-page opinion, noting: "Congress overstepped its bounds by legislating to prohibit FGM ... FGM is a 'local criminal activity' which, in keeping with long-standing tradition and our federal system of government, is for the states to regulate, not Congress." 

Currently, 27 states have laws that criminalize female genital mutilation, including Michigan, whose FGM law is stiffer than the federal statute, punishable by up to 15 years in prison, compared with five under federal law. Michigan's FGM law was passed last year in the wake of the historic case and applies to both doctors who conduct the procedure, and parents who transport a child to have it done. The defendants in this case can't be retroactively charged under the new law. ...

"There is nothing commercial or economic about FGM," Friedman writes. "As despicable as this practice may be, it is essentially a criminal assault. ... FGM is not part of a larger market and it has no demonstrated effect on interstate commerce. The commerce clause does not permit Congress to regulate a crime of this nature."

Update to Cantrell Funeral Home scandal in Detroit: More than 370 bodies found dating back to 1996

Hoo wee, this story stinks.


[A]shes of more than 370 bodies, nearly two dozen of which appear to be military veterans, ... were abandoned at Cantrell in the spring. ...

A new owner, who purchased the building about a month ago, said the interior smelled horrible. The owner had removed four dumpsters of garbage as he started renovating the space to turn it into a community center. ...

[Brian] Joseph [the owner of Verheyden Funeral Homes in Grosse Pointe Park], who arrived at Cantrell even before the state investigators, was let in by the owner.

The state contacted Joseph, [Joseph] said, because in the spring, as Cantrell's financial and regulatory problems became evident, he had offered to help the operator, Raymond Cantrell II, who had inherited the business after his father died in 2016.

Cantrell then asked Joseph to honor more than 500 of his pre-arranged funeral contracts.

The money paid on the contracts is held by a third party and Joseph said he does not profit from them. He agreed, he said, because Cantrell's father had been a contemporary of the former owner of his funeral home, and he believes that he has a duty to help others in need.

In April, the state suspended Cantrell's license, citing "deplorable, unsanitary conditions." Among the problems authorities found were six decomposing bodies — three men, two women and a male fetus — in the funeral home. 

Again, to help, Joseph quietly arranged for the bodies to be buried during the summer at Mount Olivet, which donated space and services. Santieu Vaults in Livonia donated the burial vaults which protect bodies while in the ground.

Joseph is now trying to help identify the hundreds of containers holding cremated remains, some of which appear to go back to 1996. Many of the remains have names with the date the person died, Joseph said, but finding relatives and loved ones is a challenge. ...

"It's a horrible situation," said John Desmond of A.J. Desmond & Sons Funeral Directors, summing up the problems with remains that were hidden and left behind. "This is the most egregious behavior that I have ever heard of in my 50 years of being licensed in the state of Michigan."

Detroit Free Press says Michigan is ground zero for the Muslim clit cutters, girls from MN brought in for secret "operation"

Unfortunately, Ronald Reagan's crazy libertarian Judge Bernard Friedman is presiding over the case. You remember Friedman. He was the judge who overturned Michigan's 2004 Marriage Act in 2014.

[T[he [federal] government estimates that as many as 100 girls may have had their genitals cut at the hands of a local doctor and her cohorts.

Assistant U.S. Attorney Sara Woodward disclosed the information while trying to convince a judge to keep a doctor and his wife locked up in the historic case. It involves allegations that two Minnesota girls had their genitals cut at a Livonia clinic in February as part of a religious rite of passage and were told to keep what happened a secret. ...

Against Woodward's wishes, U.S. District Judge Bernard Friedman granted bond to two other defendants in the case: Dr. Fakhruddin Attar, 53, of Farmington Hills, who is accused of letting Nagarwala use his clinic to perform genital cutting procedures on minor girls; and his wife, Farida Attar, 50, who is accused of holding the girls' hands during the procedure to keep them from squirming and to calm them. ...

The government believes the three defendants, all members of a local Indian-Muslim sect, subjected numerous girls to genital cutting procedures over a 12-year period. ...  [Dr. Attar allegedly admitted] to authorities that he let Nagarwala use his clinic up to six times a year to treat children for genital rashes. ...

The defense has argued that the Attars did not engage in any criminal  act and that the procedure at issue is a protected religious rite-of-passage that involves no cutting, but rather a scraping of genital membrane.
