It breaches a core rule-of-law principle, designed to promote constancy in the law. In doing all of that, it places in jeopardy other rights, from contraception to same-sex intimacy and marriage. And finally, it undermines the Court’s legitimacy.”

If you want to know why America is dying, look no further than Warren Buffett, a man at war with human nature, who frankly doesn't care that without fertility there will be no one left to consume.

Quietly, steadily, the Buffett family is funding the biggest shift in birth control in a generation. “For Warren, it’s economic. He thinks that unless women can control their fertility—and that it’s basically their right to control their fertility—that you are sort of wasting more than half of the brainpower in the United States,” DeSarno said about Buffett’s funding of reproductive health in the 2008 interview. “Well, not just the United States. Worldwide.” ...

In the 1960s, the [Buffetts] set up what was then called the Buffett Foundation, which focused on nuclear disarmament and reproductive health, including helping to fund Planned Parenthood as well as the development of RU-486, the so-called abortion pill. In the late ’70s, the duo entered into an unusual arrangement—they remained married, but Susan moved to San Francisco.

The [contraception] rule implicitly asserted that our nation will not tolerate an institution that is unwilling to actively ratify the views of those in power — that we will not let it be and find other ways to put those views into effect (even though many other ways exist), but will compel it to participate in the enactment of the ends chosen by our elected officials. This is an extraordinarily radical assertion of government power, and a failure of even basic toleration. It is, again, an attempt to turn private mediating institutions into public utilities contracted to execute government ends.

George Will Only Imagines Congress' Power Has Been Limited, But It Hasn't

If the mandate had been upheld under the Commerce Clause, the Supreme Court would have decisively construed this clause so permissively as to give Congress an essentially unlimited police power — the power to mandate, proscribe and regulate behavior for whatever Congress deems a public benefit. Instead, the court rejected the Obama administration’s Commerce Clause doctrine. The court remains clearly committed to this previous holding: “Under our written Constitution . . . the limitation of congressional authority is not solely a matter of legislative grace.”

The fact remains, however, that with the stroke of a pen the Court has changed the locus of unlimited power-seeking from the venue of commerce to the venue of taxation. Congress' power "to mandate, proscribe and regulate behavior" hasn't been diminished one bit, just shifted.

I can now be penalized (!) with a tax (!) for not buying whatever Congress' decides. This used to be a power reserved to the States, which can force you, say, to purchase a gun. Now the Court has given that power over you to the Congress, by-passing the States.

The issue was well-framed for us already, in the dead of winter, during the Republican primary debate about RomneyCare, here:

One difference between the health care bills is that Romneycare is constitutional and Obamacare is not. True, Obamacare's unconstitutional provisions are the least of its horrors, but the Constitution still matters to some Americans. ... As Rick Santorum has pointed out, states can enact all sorts of laws -- including laws banning contraception -- without violating the Constitution. That document places strict limits on what Congress can do, not what the states can do. Romney, incidentally, has always said his plan would be a bad idea nationally. The only reason the "individual mandate" has become a malediction is because the legal argument against Obamacare is that Congress has no constitutional authority to force citizens to buy a particular product. ... States have been forcing people to do things from the beginning of the republic: drilling for the militia, taking blood tests before marriage, paying for public schools, registering property titles and waiting in line for six hours at the Department of Motor Vehicles in order to drive. There's no obvious constitutional difference between a state forcing militia-age males to equip themselves with guns and a state forcing adults in today's world to equip themselves with health insurance.


But now the Congress has this power, under the taxing authority, at least until some enterprising citizens challenge healthcare premiums they actually pay as a form of unapportioned direct taxation, and win.

Until then, we have no place left to hide. The whole country has become Massachusetts.

Romney's Arizona Debate Statements on Plan B Drugs Fail Scrutiny

Evidence presented here indicates that Gov. Romney lied twice during the debate:

When Romney was asked in the debate if he had required Catholic hospitals to provide emergency contraception to rape victims and had infringed on Catholics’ rights, he responded, “No, absolutely not. Of course not.” That was untrue.

When Romney said “for the Catholic Church to provide morning-after pills to rape victims…was entirely voluntary on their part”, that was also untrue.

The evidence indicates Romney came under pressure from legal counsel, under which he flip-flopped, but also that he personally embraced the idea of forcing Catholics to act contrary to conscience as the right thing to do.

How this makes him any different from Barack Obama who routinely acts in a capricious, authoritarian manner is beyond reconciliation.

A vote for Romney is a vote for Jello, every night.

Obama Knows His Base Is Women, And ObamaCare Was Designed For It

Romney would lose in November because he's competing for a voting block which Obama already owns. While 48 percent of Romney's voters said they were Republican, 41 percent self-identified as Independent.

Once again, from the Florida exit polling here, Romney's biggest support came from women (52 percent), Hispanic/Latino (54 percent), moderate/liberal (59 percent), oppose Tea Party (57 percent), Roman Catholic (56 percent), and the abortion should be legal crowd (54 percent).

Compare that with this from CNN (here):

Catholic teaching opposes abortion and the use of contraceptives, though a 2011 study by the Guttmacher Institute showed 98% of sexually active Catholic women had used contraception.

The Democrat strategy, as always, is to divide and conquer, but when it comes to the Catholic church, there isn't a lot of dividing work to do. Obama has known for a long time that the loyalty of Catholic women to the church is divided over reproductive issues, as is the loyalty of Christian women generally.

Women in this country want the freedom to kill their unborn children. Otherwise Roe v. Wade would not continue to stand.

Obama knows his base. ObamaCare was designed for it. Catholic women in Florida went for Romney like they'll be going for Obama in November. The better to eat you with, my dear.
