Biden's immigration orders are as illegal as Obama's: The president has plenary statutory authority under 8 U.S.C. 1201 to deport any alien (legal or illegal) at any time for any reason, but he does not have any reciprocal power to naturalize aliens outside of Congress

 


 During the fledgling nation's constitutional ratification debates, which assumed existential importance after the failure of the Articles of Confederation, Federalists felt compelled to distinguish the presidency from the Crown on the grounds that the king "can make denizens of aliens" but the president has no such power. Indeed, the Framers cared so much about this that they explicitly accorded to Congress, in Article I, Section 8 of the Constitution, the power to "establish a uniform rule of naturalization." The message was clear: The president is not a king.

5. Cancel President Obama’s executive actions

The GOP nominee would end the Obama administration’s Deferred Action for Childhood Arrivals immigration policy, better known as DACA, under which roughly half a million young people brought to the U.S. as children have received temporary legal status. Trump would also cancel President Obama’s DAPA program, or Deferred Action for Parents of Americans, which would give similar status to undocumented parents of American citizens. That program has been frozen as it faces court challenges.

Obama announced DAPA on November 20, 2014.

Trump launched his campaign for president just seven months later, on June 15, 2015, making illegal immigration the heart and soul of his candidacy.

Seven months.

Trump promised to overturn DACA amnesty "immediately": Well, we're waiting . . .

Immediately was yesterday. Thanks for ending TPP yesterday, but . . ..

His campaign website still includes a pledge to "immediately terminate President Obama's two illegal executive amnesties," a reference to DACA and a later executive action — Deferred Action for the Parents of Americans (DAPA) — applying to illegal immigrants with American children.

"That's crazy and confusing," said William Gheen, founder of the Americans for Legal Immigration PAC. "Donald Trump promised to end Obama's unconstitutional executive orders, and that's DAPA and DACA."
