Egads, you knew it was coming: 6th Circuit Court of Appeals panel rules 2-1 that Biden's employer vaccine mandate, previously paused, can take effect

Federal appeals court in Ohio upholds Michigan's 2004 Marriage Amendment

The Detroit News reports here:

The Michigan couple at the center of the same-sex marriage debate vowed Thursday to "continue the fight" after a federal appeals court in Cincinnati upheld the state's gay marriage ban. ...

The U.S. 6th Circuit Court of Appeals also upheld laws prohibiting gay marriage in Ohio, Tennessee and Kentucky, breaking ranks with other courts that have considered the issue and setting the stage for review by the U.S.Supreme Court. ...

Attorney General Bill Schuette, who brought the appeal ... said he welcomes a Supreme Court review. "The U.S. Court of Appeals for the 6th Circuit has ruled, and Michigan's constitution remains in full effect," Schuette said. "As I have stated repeatedly, the U.S. Supreme Court will have the final word on this issue. The sooner they rule, the better, for Michigan and the country."

Bush Appointee to 6th US Circuit Court of Appeals Tilts Ruling in Favor of ObamaCare

Thanks George you mushy headed liberal.

The ruling was by a three judge panel. The Reagan appointee voted against the healthcare mandate, while a Bush appointee and a Carter appointee voted for it, proving once again that W, who aimed to redefine conservatism in his own image, was no friend of the right.

Plaintiffs can appeal to the full, currently 15 member, 6th circuit court, or to the Supreme Court.

6th US Circuit Court of Appeals Defends Fourth Amendment on Email

“The government may not compel a commercial ISP to turn over the contents of a subscriber’s e-mails without first obtaining a warrant based on probable cause”, the appeals court ruled. The decision — one stop short of the Supreme Court — covers Kentucky, Michigan, Ohio and Tennessee.

So, how about all that email the NSA has already illegally read?

Hutaree Militia Release In Almost Comic Limbo

The Detroit News is reporting an almost comical series of developments involving the bond proceedings for the Hutaree militia members who thought they were going to be freed this week pending trial.

Prosecutors appear to be so upset with U. S. District Judge Victoria Roberts, who decided the Hutaree could be free with conditions, that Assistant U. S. Attorney Ronald Waterstreet seems to have misrepresented those conditions in his appeal of the release ruling to the U. S. 6th Circuit Court Of Appeals.

One defense attorney is quoted as saying, "Obviously, Waterstreet has completely misrepresented what was discussed with pretrial services."

Hutaree To Stay In Slammer At Least Until Friday

As reported by The Detroit News:

A federal appeals court temporarily halted the release of nine Hutaree militia defendants today, just moments before they were scheduled to be set free.

"The order of revocation is temporarily stayed pending further review and order of the court," the U.S. 6th Circuit Court of Appeals said in response to an emergency motion from federal prosecutors in Detroit.

The effect of the order is that none of the defendants will be released before Friday. The court said lawyers for the defendants are to file briefs opposing the stay by 5 p.m. today.
