6. In certain cases or controversies, civilian control is exercised within the judicial branch through judicial review of policies, orders, and actions involving the military. In practice, the power to declare a policy/order/action illegal or unconstitutional is decisive because the military is obligated (by law and by professional ethics) to refuse to carry out an illegal or unconstitutional policy/order/action. 

 

An extraordinary open letter signed by eight former defense secretaries and five former chairmen of the Joint Chiefs of Staff:

 The letter also says that civilian control of the military can be exercised by the judicial branch when an administration’s decisions are challenged, and that a court ruling is decisive because military leaders are obligated by law and professional ethics to refuse to carry out illegal or unconstitutional orders.

Senior Col. Zhao Xiaozhou, of the People’s Liberation Army’s Academy of Military Sciences, suggested in a question to Mr. Mattis that the U.S. Navy’s maneuvers near the islands could also be called militarization.

Like the US, China is free to conduct freedom of navigation patrols same as the US. That isn't good enough for China. It lays claim, illegally, to the whole area, and seeks to prohibit freedom of navigation in the area to everyone else. Building islands out of reefs and occupying them illegally and then militarizing them is proof enough of that.

Military confrontation is inevitable.

The article from WaPo is confused about the US Fleet. The 7th Fleet is Japan-based. The Italy-based Fleet is the 6th, not the 7th.

"Navy officials had previously recommended reactivating the fleet as part of broader force structure reviews following last year's deadly row of collisions among ships at the Japan-based 7th Fleet. In a separate statement, Richardson invoked Defense Secretary Jim Mattis' national defense strategy as key guidance to reestablish the fleet, which will extend halfway across the Atlantic until it meets the area of responsibility for Italy-based 7th Fleet."

SECDEF Mattis has called the joint missile strike on Syria a "single shot", not an opening salvo in a war

Mattis said the strike was a “single shot” aimed to deter the Syrian regime from using chemical weapons. Whether the United States and its allies will pursue further action in Syria would “depend on Mr. Assad should he decided to use more chemical weapons in the future," the secretary said.

The Air Force lapse in the Devin P. Kelley case, which is now under review by the Pentagon's inspector general, made it possible for him to buy guns before his attack Sunday at a church in Sutherland Springs, Texas. Twenty-six people were killed, including multiple members of some families. About 20 other people were wounded. ...

Federal law prohibited him from buying or possessing firearms after his conviction. But because it was never added to the FBI's database for background checks, Kelley was able to buy his guns.

Air Force records show Kelley initially faced charges of domestic violence for seven alleged incidents in 2011 and 2012. Five were withdrawn as part of a plea agreement, including two involving Kelley pointing a loaded gun at his wife. He pleaded guilty to striking, choking and kicking his wife and hitting his stepson "with a force likely to produce death or grievous bodily harm."

He was sentenced in November 2012 to one year in confinement and reduction in rank to E-1, the lowest enlisted rank. He was given a bad conduct discharge, which was carried out in 2014. The officer overseeing the case was Robin Rand, then a three-star general and now the four-star commander of Air Force Global Strike Command in charge of the service's bomber force and nuclear missiles.

Obama hollowed out the military and SECDEF Mattis wants to keep those responsible in place at DOD

President Trump promised to rebuild our hollowed-out military, a cause as urgent as any domestic priority. Years of Obama budget cuts and neglect slashed force sizes and provoked a readiness crisis. Over half the Navy’s aircraft are grounded. Of 58 Army brigade combat teams, only three are ready to immediately join a fight. The Air Force is short pilots and aircraft maintenance workers. ...

[Mattis] wanted, for instance, former Obama undersecretary Michèle Flournoy for a top post. He’s looked to recruit from Ms. Flournoy’s liberal-hawk think tank, the Center for New American Security. And he’s pushed for some names who hail from Never Trump backgrounds, including Mary Beth Long, an official in George W. Bush’s Pentagon.

Perhaps only to make a point, Mr. Mattis is blocking some rock-star conservative talent. One is Mira Ricardel, a former Boeing executive and Bush Pentagon alum who helped with the Trump transition. Mr. Mattis continues to nix a long list of names offered by the White House team. ...

The Pentagon today remains in the hands of Obama holdovers who have spent years thwarting congressional requests, minimizing readiness problems, and generally covering for Obama failures. Those holdovers include Deputy Secretary Robert Work, an opponent of reform, and Assistant Secretary for Legislative Affairs Stephen Hedger.

Mr. Hedger helped write an infamous 2016 Pentagon memo outlining how the Obama administration could use a presidential veto of greater defense spending as a “weapon” to get other Obama priorities. Civil servants are also place-warming other key positions. As well-intentioned as many are, it’s unrealistic to expect this crew to march in a new direction after eight years under President Obama.

It is understandable that Gen. Mattis would say he never found waterboarding useful, because no one in the military has been authorized to waterboard a detainee. Thousands of U.S. military personnel have been waterboarded as part of their training, though the services eventually abandoned the practice after finding it too effective in getting even the most hardened warrior to reveal critical information.

During the war on terror, the CIA alone had been authorized to use the technique. I personally waterboarded the only three terrorists subjected to the tactic by the CIA. I also waterboarded two U.S. government lawyers, at their request, when they were trying to decide for themselves whether the practice was “torture.” They determined it was not.

It's disturbing that prospective SECDEF Mattis says our hands are tied by the Iran deal when it's not a treaty

Even worse that he wants to predicate US action on prior European action. What is "European" action? And when have they EVER acted without US leadership?

And worse still that the land force part of the nuclear triad is negotiable. He's a M.A.D. dog all right.

Mattis has voiced deep scepticism about Iran’s motives and warned that the US and its allies would have to remain vigilant for violations. But in April he argued against walking away from the nuclear deal, as Trump has threatened to do. 

“One point I want to make is there’s no going back,” Mattis said at an event at the Center for Strategic and International Studies in Washington. “Absent a real violation – I mean, a clear and present violation that was enough to stimulate the Europeans to action as well – I don’t think that we can.”

Were the US to renege on its agreement, Mattis said, “I believe we would be alone if we did, and unilateral economic sanctions from us would not have anywhere near the impact of an allied approach to this.”

Jim Mattis happens to be a social liberal. He's more liberal than I am. He's very concerned about the debt. He's a strong national security hawk. Why wouldn't someone like him... 

Mattis is also a conventional liberal in that he subscribes to a two-state solution for Israel, just like George Bush and John Kerry.
