This order responds to reports that personnel of the Federal Bureau of Investigation (FBI) provided false information to the National Security Division (NSD) of the Department of Justice, and withheld material information from NSD which was detrimental to the FBI's case, in connection with four applications to the Foreign Intelligence Surveillance Court (FISC) for authority to conduct electronic surveillance of a U.S. citizen named Carter W. Page. When FBI personnel mislead NSD in the ways described above, they equally mislead the FISC. ... The FBI's handling of the Carter Page applications, as portrayed in the OIG report, was antithetical to the heightened duty of candor described above. The frequency with which representations made by FBI personnel turned out to be unsupported or contradicted by information in their possession, and with which they withheld information detrimental to their case, calls into question whether information contained in other FBI applications is reliable.

But it should have, especially if Mifsud denied Papadopoulos’ claim that the Maltese professor had bragged that the Russians had dirt on Hillary. Or was Mifsud an FBI informant or an asset of a foreign government, and was that instead what the DOJ told the FISA court?

It’s time for the FBI to come clean: Who was Mifsud, and what was his role in the launch of Crossfire Hurricane? And did the State Department assist the FBI in handling Mifsud? Congress and the president supposedly hold power over these agencies. They, and we, need the answers.

The announcement was unusual, but buried in the Friday night data dump, which is actually pretty thin because of the shutdown.

The Foreign Intelligence Surveillance Court has granted the National Security Agency (NSA) permission to continue its collection of records on all U.S. phone calls.

The Office of the Director of National Intelligence announced the court's approval in a statement late Friday. The court authorizes the program for only limited time periods and requires that the government submit new requests every several months for re-authorization.

The existence of the bulk phone data collection was one of the most controversial revelations from the leaks by Edward Snowden.

Judge Bates found that the agency had violated the Constitution and declared the problems part of a pattern of misrepresentation by agency officials in submissions to the secret court. ... “The court is troubled that the government’s revelations regarding N.S.A.’s acquisition of Internet transactions mark the third instance in less than three years in which the government has disclosed a substantial misrepresentation regarding the scope of a major collection program,” Judge Bates wrote.

Britain’s Guardian newspaper posted online late Wednesday a copy of the “Top Secret” FISA court order directing telecommunications giant Verizon to hand over “metadata” about every call made or received by all of its customers in the United States. Such metadata include the calling and receiving phone numbers, the time of day and length of the call, and the whereabouts of the two parties.

Mr. Binney noted the order’s serial number, which indicates it is the 80th issued by the FISA court so far this year. The court likely has approved similar orders for the other major U.S. telecom providers, he said, “and they have to be renewed every 90 days.”
