The founders set up a country in which aristoi would rule alongside and with the people, first among equals, primus inter pares, but not over them in the monarchical or oligarchic sense. Nobody would have a permanent or divine right to rule in the United States. The founders had had a sense of duty to rule honorably, and a sense of humility that their governance wasn’t an end in itself — but a means of preserving the rights of the people to life, liberty, and the pursuit of happiness.

Does Carson Holloway for The Federalist even live in America 2020, torn by $2 billion in damages from rioting and looting?

Tocqueville was certainly correct that the dire legacy of slavery would not be eliminated immediately upon its abolition. America’s path toward racial justice was long and difficult, continuing for many decades after the end of the Civil War. Nevertheless, over time the process turned out better than Tocqueville expected. The country was not engulfed in a race war, and whites and black Americans gradually learned to live with each other as fellow citizens.

If you subscribe to ideology qua ideology, you can pretend that what your lyin' eyes are trying to tell you isn't true. And Holloway explicitly embraces the ideological habit of mind which blinds him to our reality:

Moreover, the northern settlers — and particularly the Puritans of New England — came to America not only with the general habits of freedom characteristic of all the English but with a peculiarly intense inclination toward self-government. They came, Tocqueville says, driven by a “purely intellectual craving,” seeking the “triumph of an idea.”

Accordingly, he embraces a sharp, ideological distinction between North and South, which is nothing but a caricature, as if neither love of lucre nor racism existed in the North: 

Tocqueville clearly regards the original southern settlers as less moral and less enlightened than their northern counterparts. The northerners came to America primarily to found self-governing communities based upon their (lofty and demanding) religious vision of a righteous society. The original Virginians came primarily in the pursuit of gain.

You will hardly find in American "conservatism" anywhere any rumination on the founding of the colonies as corporations, entities which were explicitly formed for gain for and by the English Crown in cooperation with the Bank of England. That was the whole point of Samuel Johnson's "Taxation No Tyranny", which ridiculed Americans with "Why do we hear the loudest yelps for freedom from the drivers of Negroes?", which is the main reason why no one reads it. The American colonists broke the business deal with the Crown, violating their contracts. We responded by gussying up our thefts with lofty bs about freedom and equality and rights. French loans, and the French navy, helped us get away with it.

Tocqueville's antipathy toward the South is an artifact of French affinity for the excesses of those Enlightenment ideas which enjoyed a higher traffic in the American North, but also of immemorial French hatred for England which enjoyed free trade with the American South. He is hardly the guide Holloway makes him out to be. 

If there is any commonality left with the French vein in 2020 America, we have seen it in our streets with the violence, destruction, and blood-letting too reminiscent of the excesses of the French Revolution. The difference is that French republicanism sought to literally behead aristocrats, whereas now the rage is explicitly racial, focused on whites.

We have not learned to live with each other as fellow citizens. Cancel culture is everywhere, a euphemism for murder. The triumph of the ideas of BLM will literally mean the death of whitey. 

Any conservatism which pretends otherwise isn't worthy of the name.

A Massachusetts liberal for The Atlantic vaguely realizes that the wealthy have withdrawn their money from productive purposes

In other words, they've behaved like ordinary people behave, as in badly.

This was first made possible in America broadly by the Kennedy and then the Reagan tax cuts (Irish anyone?), which took away the high-taxation-goad that prodded income into productive investments which in turn benefited more people, but this never occurs to the author, here:

[A]round the world and throughout history, the wealthy have advanced the crystallization process in a straightforward way. They have taken their money out of productive activities and put it into walls.

The whole point of conservatism has been that human nature is mixed, so that "class" is mostly irrelevant. The author, however, is preoccupied with it, especially the "New American Aristocracy", which means he's a liberal who is (mostly) convinced some people are more equal than others for various reasons, which he goes to great, and sometimes convincing, lengths to demonstrate, and criticize.

That's a start.

Conservatives answer that good people and bad people populate the whole at every level, and that everyone has a little bit of each in them at the same time. Conservatives also believe that good government is government which encourages the good in everyone and discourages the evil. Bad government denies that this is government's responsibility at all, or it denies that one of these two irreducible facts of life is a fact so that you get liberal government which lets people run amok or tyrannical government which is too restrictive.

The author's answer is more equality when understanding how we all already are equally good and evil would be better. It's the peculiar blind spot of liberalism, the analogue of which in conservatism is failing to see the good in people:

But we do have a blind spot, and it is located right in the center of the mirror: We seem to be the last to notice just how rapidly we’ve morphed, or what we’ve morphed into. The meritocratic class has mastered the old trick of consolidating wealth and passing privilege along at the expense of other people’s children.

Not to be outdone by P. J. O'Rourke, libertarian Mark Perry also genuflects toward the hypocritical French today

Namely toward Frederic Bastiat, here, who wrote against "legal plunder", never once mentioning that the estate off of which Bastiat derived his living had been stolen from the aristocracy during the French Revolution.

Mark Perry is not just a one-off, either. Bastiat is a hero to libertarians generally. For example, to Rep. Justin Amash, who not coincidentally owes his fortune to the family business in tools, which are manufactured in China, not the united States.

Aren't Keynesianism and Homosexuality Equally Forms Of Psychological Rebellion?

It Takes One To Know One: Carl Bernstein Smells Radicalism In The Air

Carl Bernstein of Woodward-Bernstein fame thinks he's caught a whiff of radicalism in Mitt Romney and the Tea Party, here at The Daily Beast, imagining all sort of vain things about both of them.

By the end of the hysterical tirade he calms down a little and realizes his own progressivism qualifies as radicalism, too, but he'd much rather call his beloved progressivism a "transformational movement". In other words, "progressivism good, radicalism bad", sort of like how liberalism got a bad name and had to be replaced at all costs if liberalism were to continue to retain influence.

The reality is the Tea Party is a reactionary movement trying to forestall the radicalism of Barack Obama. Reactionary movements often are mistaken for radical movements because in order to succeed in their objective they have to get to the root being yanked out of the ground by others, by the revolutionaries, and replant it. As such reactionaries, the Tea Partiers are counter-revolutionaries: "Put It Back!"

This is not to say that reactionary movements cannot be hijacked by ideologues any less than true revolutionary movements are inspired by them. The American revolutionaries are a case in point. They never embraced the idealisms which turned into a class war against aristocrats in France. It is unthinkable that the history of the early American independence movement would have turned out as it did had it otherwise been a movement about liberty, equality and fraternity. Former loyalists were welcomed back. While enthusiasm for the idealism of natural rights among Tea Party activists is reminiscent of this, especially among the libertarian elements, the genesis of the movement was in reaction to Obama's proposed mortgage bailouts of deadbeat homeowners, many of whom were becoming infamous for "walking away". Like a good reactionary, Rick Santelli gave voice to his indignation at these people on national television in February but characteristically planned a Tea Party protest on the beach of Lake Michigan for months later, during his summer vacation. In the interim, he had to go to work.

The people, however, had other ideas about waiting. But unlike real radicals such as the Occupy Wall Street types, their protests were peaceful, orderly, clean, and came to an end, and then transformed themselves into the constructive activity of political action, retaking the US House in 2010 for the Republicans in order to stop Obama. As a political movement, it should be understood in those practical prophylactic terms despite the efforts of Republicans to co-opt the movement. The Tea Party is a movement of Americans who are radical only in the sense that they have rediscovered their roots in the constitution and the world which gave it birth.

The true radicals in the bad sense are those who would extirpate them.

How About 10,000 US Representatives Instead of 435?

Many people, rightly in my opinion, point to the decline of religious faith, traditional morality and constitutional respect for both as a leading cause of our current discontents. In making this argument, however, some fall prey to an ahistorical understanding of the priority of the 1st Amendment, and miss an important remedy which animated the founding generation just as much did the principle of religious freedom.

The latest example of the myth of the priority of our 1st Amendment to the US Constitution is repeated by none other than John Garvey, president of The Catholic University of America, for The Baltimore Sun (link), whose other observations I otherwise find wholly unobjectionable:

[T]he right to religious freedom — the first freedom mentioned in the Bill of Rights — was of great importance to the framers of our Constitution.

Mr. Garvey operates under the common misapprehension that the 1st Amendment is somehow first because of James Madison's statements in various places about the priority of religious liberty as an unalienable right whose basis is in the creator. Accordingly Garvey quotes Madison, "This duty is precedent both in order of time and degree of obligation, to the claims of Civil Society," as if this proves why The Bill of Rights starts the way it does and that we should therefore insist more urgently that 1st Amendment considerations somehow take the lead in our civil deliberations over contentious issues, especially as affecting institutions of The Church. It is to some extent an appeal to the authority of what has primacy, which one might expect of a Roman Catholic.

If Madison could hear this, however, he would no doubt laugh, because he himself authored what was the original first amendment, and it had nothing to do with freedom of the press, the free exercise of religion, etc.

Mr. Garvey's ignorance of the historical situation is not unusual, inasmuch as most of us, if we are familiar at all with even the basic facts of history, are children of the federalists who prevailed at the founding and wrote the constitution. We do not remember the arguments of their opponents, the anti-federalists, nor the issues which animated them, probably because we were never taught them.

The short version of a part of this very complicated history is that there was a list of at least twelve amendments proposed in 1789, and what we call our 1st Amendment was actually third in that list, which, with numbers four through twelve, was ultimately ratified while the two preceding were not. These go largely unremarked today, which is a pity because they reveal that if anything animated the minds of the founders as a matter of first importance, it was the idea of adequate representation. And it was this which was a chief pre-occupation of the anti-federalists, who viewed the constitution as a federalist conception of a defective republicanism which co-opted and undermined local constituencies and state governments. To the men of the anti-federalist camp, the more the representation, the less the chance of despotism.

As an historical phenomenon, representation's importance in the founding era formed a unity with taxation, as in "no taxation without representation."

This is why the first article of the constitution concerns itself with establishing the legislative authority, which the founders considered the predominating power in the new government, and its power to tax, both of which were to be apportioned to the states by population. Hence the census. But the constitution failed to delimit the maximum size of legislative representation, only that the number of representatives should not exceed one for every 30,000, and thus amendments were proposed.

The original amendments 1 and 2 read as follows:

Article I:

After the first enumeration required by the first article of the Constitution, there shall be one representative for every thirty thousand, until the number shall amount to one hundred, after which the proportion shall be so regulated by Congress, that there shall be not less than one hundred representatives, nor less than one representative for every forty thousand persons, until the number of representatives shall amount to two hundred; after which the proportion shall be so regulated by Congress, that there shall be not less than two hundred representatives, nor more than one representative for every fifty thousand persons.

Article II:

No law varying the compensation for the services of the Senators and Representatives, shall take effect, until an election of Representatives shall have intervened.

Because Article I was not ratified, the deficiency of the original constitution's provisions for representation, though hotly debated at the time, was never successfully remedied. The deficiency is that the constitution does not specify the "maximum district size", in the words of thirty-thousand.org (link), which happens to be a veritable cornucopia of scholarship on this problem. Its author points out that our US House of Representatives, if it followed the constitution's original intent, would now consist of 10,000 representatives instead of just 435, a number fixed by the Congress in 1929:

Because this part of the Constitution is still “defective”, Congress can choose to grant its constituents virtually any number of Representatives it deems appropriate. In fact, Congress can choose both the number of Representatives and the algorithm by which they are allocated among the states. In contrast, the role of the Census Bureau is limited to conducting the decennial census and applying, to that result, the apportionment algorithm specified by Congress in order to calculate the allocation of House memberships. 

No one alive today who takes politics seriously can say with a straight face that he feels adequately represented by any politician of any party. Gallup would not report polls indicating the extreme low esteem for Congress that it does were it otherwise. Congressmen are remote and aloof, unresponsive even to their erstwhile supporters. Senators are even worse, to say nothing of the president. This was precisely the future predicted by the anti-federalists.

It might come as something of a surprise, perhaps, to thirty-thousand.org, that the anti-federalists were none too happy even with the constitution's idea that "the number of representatives shall not exceed one for every thirty thousand." Some of them could not imagine that one man could adequately represent so many people even as that.

Madison's attempt to set the representation progressively, stopping at one per fifty thousand, indicates something of his federalist sympathies, as well the limits of his imagination as to the potential growth of the American population.

In either eventuality, it must be said, Americans today would be better represented with more representatives than the few we currently have, whose nearly impenetrable incumbency makes them a veritable hereditary aristocracy of power and indeed tyranny over the lives of the Americans the founders intended them to represent.

What we have today is representation without representation, which is why Mr. Garvey rightly feels The Church to be under attack. Too much power is concentrated in too few hands, which is just the way the opponents of all that is good, true and beautiful like it.

The last thing they want is a US House of Representatives populated with 2300 Catholics.

Net Return On Massive Secret Loans To Biggest Banks By Federal Reserve Was Barely 1 Percent During Subprime Meltdown Between 2007 and 2009

This while home buyers in the US in 2007 with excellent credit were paying 6 percent or more for 30 year fixed rate mortgages.

Here's the propaganda line from the article:

But the depression wasn't averted, no matter how much lipstick Bloomberg tries to put on this pig:

While the 18-month U.S. recession that ended in June 2009 after a 5.1 percent contraction in gross domestic product was nowhere near the four-year, 27 percent decline between August 1929 and March 1933, banks and the economy remain stressed.

Instead of "banks and the economy remain stressed," how about, "it was a depression nevertheless"? We now know thanks to revised GDP numbers released by the government in its annual revision in July that GDP went slightly negative for the first time in 2008, followed by a substantial negative GDP report for 2009. Two back to back years of negative GDP are a depression, just as surely as two back to back quarters of negative GDP are a recession. Clearly not the Great Depression, but a depression nonetheless.

Yet we still can't bring ourselves to say it.

As usual, the banks are ground zero for depression, whether it's under the Federal Reserve Act of 1913 which was meant to prevent booms and busts, or not:

Data gleaned from 29,346 pages of documents obtained under the Freedom of Information Act and from other Fed databases of more than 21,000 transactions make clear for the first time how deeply the world’s largest banks depended on the U.S. central bank to stave off cash shortfalls. Even as the firms asserted in news releases or earnings calls that they had ample cash, they drew Fed funding in secret, avoiding the stigma of weakness.

Why do you think there's been such a flight to cash ever since, first by the banks, then by the corporations, and now by the citizenry, always the last to know?

Nothing has changed, and nothing has been fixed. 

Debt that can be repaid might be. What cannot be repaid won't be. Not ever. And that's what depressions in real capitalist economies are for: quick, dirty and nasty little episodes of failure which reset the chess board. Except we can't seem to accept that because we're not really a capitalist society anymore, which is why this sorry tale keeps dragging on.
