Left wing attorney Ken Chesebro pleads guilty to one felony count in Georgia election interference case, Sidney Powell to six misdemeanor counts

 Kevin Breuninger for CNBC calls Powell a right-wing attorney, but to him long time left-wing ally of Laurence Tribe Ken Chesebro is just a Trump campaign attorney.

They both face fines and long probationary periods in exchange for rat-finking on the others.

IRS whistleblower says Hunter Biden could have been charged with failure to file or pay taxes for each of the 5 years 2015-2019 and felony tax evasion and/or filing a false return for each of the years 2014, 2018, and 2019


 Earlier this week, Biden agreed to enter guilty pleas for two misdemeanor tax charges that related to his failure to pay tax on more than $3 million in income. As part of the deal with Delaware U.S Attorney David Weiss — who was appointed by then-President Donald Trump and was kept in the position by the current administration to continue the probe —  Biden will avoid full prosecution on a separate gun possession charge. A Delaware judge must approve the agreement at a hearing currently set for July 26.

LOL, DC Mayor and President Biden both oppose DC's soft-on-crime bill, progressive Democrats, but I repeat myself, are outraged

 The crime bill passed the D.C. City Council unanimously in January. After Washington D.C. Mayor Muriel Bowser (D) vetoed it, the city council overrode it 12-1. Among other things, the bill would eliminate most mandatory sentences and lower penalties for a number of violent offenses, including carjackings and robberies. It would also expand the requirement for jury trials in most misdemeanor cases. 



Say what you will about Biden or Bowser, these two do not want to become Beetlejuice, who just lost her mayoral re-election bid because 63% of Chicagoans no longer feel safe there.
 
Sounds more and more like Joe is running, doesn't it?
 
His Energy Department last week endorsed the possibility of COVID-19 being a lab leak, followed in short order by the FBI saying the same, which the progressives still call a conspiracy theory.

Anyone invited into the Capitol by Capitol police on January 6th (there's video for crying out loud) but still prosecuted will rightly find this to be a double standard

 

In a statement, the U.S. Attorney’s Office for the District of Columbia said that after reviewing the evidence, it “cannot move forward with misdemeanor charges of unlawful entry against the nine individuals who were arrested on June 16, 2022 at the Longworth Office Building.”

The office confirmed that those individuals had been invited in by congressional staffers “and were never asked to leave by the staffers who invited them, though, members of the group had been told at various points by the U.S. Capitol Police that they were supposed to have an escort.”

Betsy's right: High crimes and misdemeanors means offenses committed while in high office

It's not the severity of the crime which makes it high, but it damn well better be a crime. Democrats haven't been able to come up with one despite turning themselves and the country into pretzels.

And Trump's tax returns from the past and his dalliances from the past and why he named his son "Barron" are all completely irrelevant, as is everything else he's done while not in office. Those things matter only at election time.

At the 1787 Constitutional Convention, the framers considered grounds for impeachment. On Sept. 8, George Mason suggested that bribery and treason were too narrow, and proposed adding "maladministration." But James Madison objected, explaining that "so vague a term will be equivalent to" saying the president serves at the pleasure of the Congress. The framers did not want to duplicate the British system, which made the executive dependent on Parliament. Mason's idea was dropped, and the framers instead agreed to the more specific term, "high crimes and misdemeanors," where "high" meant offenses committed while in high office, such as embezzling public funds.

The meaning of "high" in "high crimes and misdemeanors" refers not to the nature of the offenses, but to their sphere

[I]t was essential to their way of thinking to make clear that impeachment was a political process dealing with political wrongdoing and not a part of the criminal justice process. Thus, they made clear that punishment for impeachment could not "extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States." But they emphasized that impeachment was not a bar to prosecuting criminal acts that the person impeached may have committed by noting that "the Party convicted [of impeachment] shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law." Thus, although an indictable crime may be deemed an impeachable offense, impeachable offenses are not simply limited to indictable crimes. ...

In all of the English cases the political nature of the offenses charged in impeachments was revealed by the use of the word "high" to modify both "crimes" and "misdemeanors." The use of "high" in "high crimes and misdemeanors" did not refer to the substantive nature of the offense, that it was a particularly serious offense, but that it was a "crime or misdemeanor" carried out against the commonwealth itself. This use of "high" to distinguish crimes and misdemeanors against the society as a whole derived from its use in distinguishing "high" treason from "petit" treason. Alexander Hamilton summarized this understanding of "high Crimes and Misdemeanors" as adopted by the Federal Convention in his explanation of the impeachment process created by the Constitution. The objects of impeachment, he noted, "are those offenses which proceed from the misconduct of public men, or, in other words, from the abuse or violation of some public trust. They are of a nature which may with peculiar propriety be denominated POLITICAL, as they relate chiefly to injuries done immediately to the society itself."

Yesterday Rush told us a crime was necessary to impeach Rosenstein, but today no crime's necessary to impeach Trump

Ah, high crimes and misdemeanors.

Once again, since misdemeanors are "minor wrongdoings", The Constitution cannot be made to say "high minor wrongdoings" in the sense of "severe", as in "severe minor wrongdoings", which would make no sense. "High" refers to where they occur, in federal office, not to their severity. Crimes are severe in and of themselves compared with misdemeanors, which by definition are not. Therefore, "crime" alone is not necessary for impeachment. A minor wrongdoing will do, committed in high office, that is, in the federal government.

Impeachment is the political remedy for both in the political context, i.e. in the federal government.

Once again, Rush is confused, and the House dropping impeachment of Rosenstein is probably a good thing, politically, because Trump could be impeached for almost nothing at all, as long as there is support for it. Best not to get everyone together on that by going after Rosenstein for a misdemeanor.

Anyway, Professor Dershowitz said this would be a very, very bad precedent because impeachment is always a remedy for criminal activity, criminal behavior. And it’s very risky here to go out and try to impeach Rosenstein simply ’cause he won’t turn things over to you. It’s kind of a tough case to make that Rosenstein’s behaving in a criminal fashion simply because he will not respond to subpoenas that the House leadership and Devin Nunes have demanded to see some documents.

But here today:

I mean, everything [Mueller has] come up with he’s given to some other jurisdiction to prosecute or do with what they will. And impeachment, you have to understand something about impeachment. This is what this has always been about. The effort here has always been to drive Trump’s approval numbers down. Impeachment is not a criminal proceeding.

It’s political. You can impeach a president if he hadn’t committed any crime. You can try it. High crimes, misdemeanors. They are hoping to drive Trump’s approvals numbers down with all of this.

Do nothing US House begins 5-week vacation after Senate Obamacare repeal failure

Republican Speaker of the House John Boehner once infamously said that Democrat President Obama had the right to set the agenda. But now that we have a Republican president, Republican Speaker Paul Ryan doesn't see it that way.

Slow-walking Trump's agenda isn't just a Democrat goal, it's an establishment goal. Republicans don't want to see it implemented anymore than the Democrats do, which is why Paul Ryan sabotaged Obamacare repeal in the Senate and promptly adjourned. His reassurances that the House wouldn't simply pass what the Senate passed supposedly were not good enough for John McCain.

But John McCain, who everyone knows is going to promptly die anyway, simply took one for the team. "Gee, what a guy. We get to run for reelection saying we voted for repeal and the dopes will believe us". 

Remember the agenda below from Trump? Seven months already have been blown on item 5, yet without success. Election 2018 is just 15 months away, and really 14 because August is a fait accompli. The prospects for getting nothing done by then of what Trump wants accomplished look better and better by the day, and that's just the way the establishment wants it.

   

Next, I will work with Congress to introduce the following broader legislative measures and fight for their passage within the first 100 days of my Administration:

1. Middle Class Tax Relief And Simplification Act.

An economic plan designed to grow the economy 4% per year and create at least 25 million new jobs through massive tax reduction and simplification, in combination with trade reform, regulatory relief, and lifting the restrictions on American energy. The largest tax reductions are for the middle class. A middle-class family with 2 children will get a 35% tax cut. The current number of brackets will be reduced from 7 to 3, and tax forms will likewise be greatly simplified. The business rate will be lowered from 35 to 15 percent, and the trillions of dollars of American corporate money overseas can now be brought back at a 10 percent rate.

2. End The Offshoring Act.

Establishes tariffs to discourage companies from laying off their workers in order to relocate in other countries and ship their products back to the U.S. tax-free.

3. American Energy & Infrastructure Act.

Leverages public-private partnerships, and private investments through tax incentives, to spur $1 trillion in infrastructure investment over 10 years. It is revenue neutral.

4. School Choice And Education Opportunity Act.

Redirects education dollars to give parents the right to send their kid to the public, private, charter, magnet, religious or home school of their choice. Ends common core, brings education supervision to local communities. It expands vocational and technical education, and make 2 and 4-year college more affordable.

5. Repeal and Replace Obamacare Act.

Fully repeals Obamacare and replaces it with Health Savings Accounts, the ability to purchase health insurance across state lines, and lets states manage Medicaid funds. Reforms will also include cutting the red tape at the FDA: there are over 4,000 drugs awaiting approval, and we especially want to speed the approval of life-saving medications.

6. Affordable Childcare and Eldercare Act.

Allows Americans to deduct childcare and elder care from their taxes, incentivizes employers to provide on-side childcare services, and creates tax-free Dependent Care Savings Accounts for both young and elderly dependents, with matching contributions for low-income families.

7. End Illegal Immigration Act.

Fully-funds the construction of a wall on our southern border with the full understanding that the country Mexico will be reimbursing the United States for the full cost of such wall; establishes a 2-year mandatory minimum federal prison sentence for illegally re-entering the U.S. after a previous deportation, and a 5-year mandatory minimum for illegally re-entering for those with felony convictions, multiple misdemeanor convictions or two or more prior deportations; also reforms visa rules to enhance penalties for overstaying and to ensure open jobs are offered to American workers first.

8. Restoring Community Safety Act.

Reduces surging crime, drugs and violence by creating a Task Force On Violent Crime and increasing funding for programs that train and assist local police; increases resources for federal law enforcement agencies and federal prosecutors to dismantle criminal gangs and put violent offenders behind bars.

9. Restoring National Security Act.

Rebuilds our military by eliminating the defense sequester and expanding military investment; provides Veterans with the ability to receive public VA treatment or attend the private doctor of their choice; protects our vital infrastructure from cyber-attack; establishes new screening procedures for immigration to ensure those who are admitted to our country support our people and our values.

10. Clean up Corruption in Washington Act.

Enacts new ethics reforms to Drain the Swamp and reduce the corrupting influence of special interests on our politics.

On November 8th, Americans will be voting for this 100-day plan to restore prosperity to our economy, security to our communities, and honesty to our government.

What follows is my 100-day action plan to Make America Great Again. It is a contract between myself and the American voter – and begins with restoring honesty, accountability and change to Washington.

Trump laid out 28 policy prescriptions in his Gettysburg address which repudiate Obama, but Obama still says Trump has few hard and fast proposals

Obama always has had trouble with math. And denial.


"I think he is coming to this office with fewer set hard and fast policy prescriptions than a lot of other presidents might be arriving with. Do I have concerns? Absolutely, of course I've got concerns. He and I differ on a whole bunch of issues," Obama added.

Milwaukeeans volunteer to clean up rioters' mess, Governor Walker calls it "selfless caring" after blacks burn down Indian-owned BP gas station

Yeah, right up there with Jesus dying for our sins, guv'ner.

"I commend the citizens who volunteered in clean-up efforts this morning," Wisconsin Gov. Scott Walker said. This act of selfless caring sets a powerful example for Milwaukee's youth and the entire community. I join Milwaukee's leaders and citizens in calling for continued peace and prayer."

Nobody is going to call this a hate crime committed by blacks against Indian-Americans, but that's what it was. The gas station has been at the center of controversy since at least July 19th when clerk Bhupinder Sidhu fired shots to disperse juvenile delinquents from his store, some of whom earlier in June had broken windows at the station.

According to the complaint, Sidhu told investigators shortly after Sherman Park closed at 10:00 p.m. on Tuesday night, a large group of juveniles came to the store. An employee attempted to close the entrance to the store -- but couldn't because someone was holding the door open. Sidhu claimed he feared for his safety and his employee's safety -- so he took his loaded Smith & Wesson M&P .40 caliber shield handgun from behind the counter and exited the store. He said he then pointed the handgun in the air, and fired two rounds "in order to try to get people to leave the store." Investigators reviewed surveillance video, which shows Sidhu exiting the store while holding what appears to be a handgun. Sidhu can then be seen raising the gun in the air -- and the crowd can be seen scattering. Sidhu and two others are then seen following the crowd until everyone left the area near the gas station.

To The Associated Press, Sadomasochism Is Just A "Subculture"

[Castro District] Supervisor Scott Wiener's proposal would make it illegal for a person over the age of 5 to "expose his or her genitals, perineum or anal region on any public street, sidewalk, street median, parklet or plaza" or while using public transit.

A first offense would carry a maximum penalty of a $100 fine, but prosecutors would have authority to charge a third violation as a misdemeanor punishable by up to a $500 fine and a year in jail. Exemptions would be made for participants at permitted street fairs and parades, such as the city's annual gay pride event and the Folsom Street Fair, which celebrates sadomasochism and other sexual subcultures.

Since about 1994 sadomasochism et cetera have not been considered mental illnesses by medical authorities when such deviancies are "consensual". Evidently the public in San Francisco no longer consents to the regular assaults against their eyes from assorted naked exhibitionists of deviancy, which should on that logic make such malefactors henceforth technically mentally ill once again.

Wow, wasn't that easy?

Accordingly we should now be able to say that, since libertarians advocate freedom for such deviancies but habitually fail at the polls, libertarians also are mentally ill because they do not enjoy the consent of the governed. 

The followers of libertarian Jude Wanniski continue to assert that the electorate always gets it right, so since the electorate repudiates libertarianism time and time again libertarians must be mentally ill.

It remains unknown if libertarianism ever was considered a mental disorder by authorities, however.

Needless to say, the date from which civilization may be said to have ended now has been postponed thanks to San Francisco Castro District Supervisor Scott Wiener.

Great name.

Another Call To Impeach The President, This Time Over His Deportation Order

The president's executive order is an end-run around existing immigration law, as noted here:


If the citizens of this Republic still took the Constitution seriously, Obama would be impeached for his decision to unilaterally grant amnesty to certain illegal aliens. ...


The role of the President, according to Article II, Sec. 3, is to "take Care that the Laws be faithfully executed." Obama's refusal to execute Congress's immigration laws (or, for that matter, Congress's Defense of Marriage Act) is an impeachable offense. Article II, Sec. 4 states that the President "shall be removed from Office on Impeachment for... Treason, Bribery, or other High Crimes and Misdemeanors." The deliberate failure to enforce valid immigration law and allow hordes of foreigners to live and work in the U.S. is, arguably, "treason," and doing so in an election year to appease Hispanic voters could certainly be considered "bribery."

Rush Limbaugh Seriously Asks Us To Believe Elliott Abrams Was Spoon-fed

Not once. Not twice. But three times.


[I]t seems like Elliott Abrams has been had.  It seems like Elliott Abrams had a piece at National Review really ripping into Newt, was spoon-fed some out-of-context stuff. ...

So Jeffrey Lord got together with some peopl[e], and found out that it appears that Mr. Abrams been spoon-fed some stuff that he didn't question because there is an institutional dislike for Newt amongst the conservative establishment and so on and so forth. ...

[T]here were the videos of some examples selectively edited. You know, things left out and starting point of the edited version, not really the starting point. So there you have it. But, however, folks, I'm just gonna have to assume here that Elliott Abrams was spoon-fed this stuff by the Romney people.

Elsewhere in his remarks Rush lets this whopper fly:

Elliott Abrams' reputation is beyond repute [sic]. He's gold. He's the coin of the realm, and that's what made people curious.

Assistant Secretaries of State for eight years under Ronald Reagan aren't spoon-fed anything, particularly Harvard grads with BA, MA and JD degrees who go on to plead guilty to two misdemeanors of withholding information from Congress.


Gee, what could Elliott Abrams and Newt Gingrich have disagreed about in 1986 which would have caused Abrams today to attempt to re-write Newt Gingrich's relationship with Ronald Reagan in order to discredit Newt's run for president?

An "institutional dislike"?

Try a fundamental difference over the meaning and limits of conservatism.

ND Sheriff Calls in US Border Control Predator B Drone to Execute Search for $6K in Rustled Beef

Reminds me of Lincoln starting a civil war over a dead horse at Ft. Sumter.

Note the prominent emphasis on "law enforcement" at this government website (link). The use of military weaponry for law enforcement is the modus operandi of the US government at least since the Clinton regime used tanks to crush the Branch Davidians in Waco. 911 gave the strategy new impetus under the Bush regime, and the starry eyed leftist dupes who voted for Obama have witnessed nothing but a continuation of Bush policies under Obama building on the Patriot Act.

The crime here was a lousy misdemeanor offense, and escalated into a felony in part because of the sheriff's actions. More ominously, Federal level quasi-military resources were mobilized against citizens. The militarization of units of the FBI, DHS and BATFE, among others, is all part of the same pattern of Federals crossing the line into military tyranny (Is there any other kind?).

Armed with a search warrant, Nelson County Sheriff Kelly Janke went looking for six missing cows on the Brossart family farm in the early evening of June 23. Three men brandishing rifles chased him off, he said.

Janke knew the gunmen could be anywhere on the 3,000-acre spread in eastern North Dakota. Fearful of an armed standoff, he called in reinforcements from the state Highway Patrol, a regional SWAT team, a bomb squad, ambulances and deputy sheriffs from three other counties.

He also called in a Predator B drone.

U.S. Law Already Requires Aliens To Carry Proof Of Registration At All Times


TITLE 8 > CHAPTER 12 > SUBCHAPTER II > Part VII > § 1304

(d) Certificate of alien registration or alien receipt card

Every alien in the United States who has been registered and fingerprinted under the provisions of the Alien Registration Act, 1940, or under the provisions of this chapter shall be issued a certificate of alien registration or an alien registration receipt card in such form and manner and at such time as shall be prescribed under regulations issued by the Attorney General.

(e) Personal possession of registration or receipt card; penalties

Every alien, eighteen years of age and over, shall at all times carry with him and have in his personal possession any certificate of alien registration or alien registration receipt card issued to him pursuant to subsection (d) of this section. Any alien who fails to comply with the provisions of this subsection shall be guilty of a misdemeanor and shall upon conviction for each offense be fined not to exceed $100 or be imprisoned not more than thirty days, or both.

Tim Geithner and Ben Bernanke Usurped The Power Of The U.S. House Of Representatives

So why aren't they in jail? They illegally bought trash loans and credit default swaps with taxpayer money and without congressional authorization. The Fed is permitted to buy only government-backed securities. If government disobeys the law, what's treason? Why should Joe American obey any of the laws of this land when its highest ranking officials don't? Aren't these "high crimes and misdemeanors"? Karl Denninger wants to know, here:


THE FED ADMITS TO BREAKING THE LAW

Now how long will it be before something is done about it?

April 1 (Bloomberg) -- After months of litigation and political scrutiny, the Federal Reserve yesterday ended a policy of secrecy over its Bear Stearns Cos. bailout.

In a 4:30 p.m. announcement in a week of congressional recess and religious holidays, the central bank released details of securities bought to aid Bear Stearns’s takeover by JPMorgan Chase & Co. Bloomberg News sued the Fed for that information.

The problem is this: The Fed is not authorized to BUY anything other than those securities that have the full faith and credit of The United States.

In addition Ben Bernanke has repeatedly claimed that these deals would not cost anyone money. But the current value looks differently:

Assets in Maiden Lane II totaled $34.8 billion, according to the Fed, which set their current market value in its weekly balance sheet at $15.3 billion. That means Maiden Lane II assets are worth 44 cents on the dollar, or 44 percent of their face value, according to the Fed.

Maiden Lane III, which has $56 billion of assets at face value, is worth $22.1 billion, or 39 cents on the dollar, according to the Fed’s weekly balance sheet. A similar calculation for the Bear Stearns portfolio couldn’t be made because of outstanding derivatives trades.

In other words, they have lost more than half of their value.

This was and remains a blatantly unlawful activity.

The Fed has effectively usurped Article 1 Section 7 of The Constituion which reads in part:

All bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.

The Fed effectively appropriated taxpayer funds without authorization of Congress. At the time these facilities were put in place neither TARP or any other Congressional authorization existed for them to do so, and to date no bill has been put through Congress authorizing the expenditure of taxpayer funds, either through putting them at risk or via outright expense, for this purpose.

Nor does it stop with a "mere" Constitutional violation - The Federal Reserve Act's Sections 13 and 14 do not permit Fed asset purchases except, once again, for items carrying "full faith and credit" guarantees. Credit-default swaps and trash mortgages most certainly do not meet these qualifications.

I know I've harped on this for more than two years, but here we have a raw admission of exactly what was done - and there is simply no way to construe any of it in a light that conforms with either The Constitution or black-letter statutory law.

What's worse is that Tim Geithner, head of the NY Fed at the time, was very much involved in this - that is, he in effect personally, along with Ben Bernanke, usurped the power of the United States House.

The Fed has spent two years trying to hide this from the public and Congress. It has fought off both Congressional demands for disclosure and multiple FOIA lawsuits, the latter of which has resulted in a series of adverse rulings (and, it appears, was ultimately going to force disclosure anyway.)

These actions are unacceptable but promising "never to do that again" is insufficient. In a Representative Republic where the rule of law is supposed to be paramount - that is, where we do not crown Kings and relegate everyone else to the status of knaves, unlawful actions such as this demand that strong and unmistakable sanction also be applied to all wrongdoers in addition to protection against future abuse.

In this case this means that both Geithner and Bernanke must go - for starters.

Amending The Federal Reserve Act of 1913 (as Chris Dodd has proposed to prevent future lending bailouts) is not sufficient in that The Fed did not lend in this case, it purchased, and by buying what we now know were trash loans it violated the black letter of existing law.

There is only one effective remedy for an institution that has proved that it will not abide the law: it must be stripped of all authority that has been in the past and can be in the future abused.

This means that The Fed, if we are to keep it at all, must be relegated to a body that only practices and provides monetary policy - nothing more or less - and that all monetary operations must be performed openly, transparently, and within those constraints.

We cannot have a republic where an unelected body is left free to violate The Constitution with wild abandon and those acts are then allowed to stand.

One final thought: If the individuals responsible for this blatant black-letter violation of the law do not face meaningful sanction for these acts, and neither does The Fed as an institution, can you fine folks over at The Executive, Judiciary and Legislative branches of our government please explain to us ordinary Americans why we should obey any of the laws of this land when you will not enforce the laws that already exist?
