If Trump’s foreign policy is misguided or “threatening,” that’s a matter for the Congress and/or the American public, not the FBI. However “threatening” one regards Trump’s foreign policy relating to Russia, the FBI’s abuse of its powers to investigate an elected official due to disagreement with his ideology or foreign policy views is at least as dangerous, it not more so, and the fact that those policy disagreements are characterized as “national security threats” does not make those actions any less threatening or abusive – whether for Trump, Henry Wallace or George McGovern.

It’s certainly possible, as the always-smart Harvard Law Professor and former Bush DOJ official Jack Goldsmith wrote at Lawfare, that the FBI had far more grounds that is currently known for opening this investigation. But based on what we do know, Goldsmith adeptly argues, there is a potentially disturbing incident of serious overreach of the FBI’s role and grave abuse of its vast investigative powers. While Goldsmith is clear that he is not yet adopting this view – in part because some facts are unknown and in part because the Constitutional issues are murky – he lays out what the potential dangers are . . ..

Elizabeth Talking Bull takes private DNA test to prove she's "Native American"

Well, she obviously took the private test and hired Bustamante because the tests you and I take wouldn't show what she needed to show.

The inherent imprecision of the six-page DNA analysis could provide fodder for Warren’s critics. If her great-great-great-grandmother was Native American, that puts her at 1/32nd American Indian. But the report includes the possibility that she’s just 1/512th Native American if the ancestor is 10 generations back. ...

Detecting DNA for Native Americans is particularly tricky because there is an absence of Native American DNA available for comparison. This is in part because Native American leaders have asked tribal members not to participate in genetic databases. ...

To make up for the dearth of Native American DNA, Bustamante used samples from Mexico, Peru, and Colombia to stand in for Native American. That’s because scientists believe that the groups Americans refer to as Native American came to this land via the Bering Straight about 12,000 years ago and settled in what’s now America but also migrated further south. His report explained that the use of reference populations whose genetic material has been fully sequenced was designed “for maximal accuracy.” ...

Ivy League universities, like the ones where Warren taught, were under great pressure to show they had diverse staffs.

The University of Pennsylvania filled out a document explaining why it hired a white woman over minority candidates — clear evidence it didn’t view her as a Native American addition. And the Globe interviewed 31 Harvard Law School faculty members who voted on her appointment there, and all said her heritage was not a factor. 

Update: The Boston Globe has amended the first paragraph above as follows:

The inherent imprecision of the six-page DNA analysis could provide fodder for Warren’s critics. If O.C. Sarah Smith were fully Native American, that would make Warren up to 1/32nd native. But the generational range based on the ancestor that the report identified suggests she’s between 1/64th and 1/1,024th Native American. The report notes there could be missed ancestors. 

In other words, Elizabeth Talking Bull could have far less "American Indian" blood in her than originally reported.

Indirect deaths from hurricanes from 1963-2012 numbered 1,418 but Maria in Puerto Rico alone caused 2,911?

My mother died of old age related heart failure two days after Hurricane Gustav made landfall in Louisiana in 2008:

48 deaths in the state of Louisiana were blamed on Hurricane Gustav. Five were due to falling trees, two due to a tornado and the rest were indirect deaths.

My mother wasn't counted among the 41 indirect deaths in Louisiana, for the main reason that she died in a different state.

But . . .

Hurricane Fatality Reports Leave Out Thousands of Indirect Deaths, According to New Study:

Looking at 59 hurricanes in the Atlantic Basin from 1963 through 2012, the study found that those systems killed a combined 1,803 people directly – by forces like flooding and airborne debris that were caused by the storm itself. But there were also a slew of lingering impacts that proved deadly in those storms, which caused 1,418 "indirect" deaths, according to the findings. ... Nearly half of the indirect deaths attributed to these 59 hurricanes were heart attacks, according to the study's data. Automobile accidents were also a major threat to life, whether the crashes occurred during evacuation or after the storm.

So we're supposed to believe tonight that about 2,911 (2,975-64) Puerto Ricans died indirectly in consequence of one storm (Maria) over the next six months according to the new math of George Washington University and Harvard University when over the course of nearly 50 years' worth of hurricanes indirect deaths for all storms combined came to just 1,418.

Sure we are.

Democrats: Happy to outsource average Americans' jobs while finger-wagging them for failure to evolve on social codes

Electorally, MBA students have become something of a voting bloc. In the 2016 presidential election, Harvard Business School polled students on their choice of candidate. A full 85 percent supported Hillary Clinton while 3 percent backed Donald Trump (for reference: 32 percent of voters went for Trump across deep-deep-blue Massachusetts). Up the street at the M.I.T. Sloan School of Management, I’d wager that the Clinton-Trump gap was just as wide, if the funereal atmosphere at our election night watch party was any indication.

The conclusion of The Intercept's story on the leaked NSA report about election hacking is total crap

The NSA conclusion “demonstrates that countries are looking at specific tactics for election manipulation, and we need to be vigilant in defense,” said [Harvard University's Bruce] Schneier. “Elections do two things: one choose the winner, and two, they convince the loser. To the extent the elections are vulnerable to hacking, we risk the legitimacy of the voting process, even if there is no actual hacking at the time.”

Throughout history, the transfer of power has been the moment of greatest weakness for societies, leading to untold bloodshed. The peaceful transfer of power is one of the greatest innovations of democracy.

“It’s not just that [an election] has to be fair, it has to be demonstrably fair, so that the loser says, ‘Yep, I lost fair and square.’ If you can’t do that, you’re screwed,” said Schneier. “They’ll tear themselves apart if they’re convinced it’s not accurate.”

IN OTHER WORDS, THE TRUMP ELECTION WAS ILLEGITIMATE BECAUSE HILLARY WON'T SAY 'YEP, I LOST FAIR AND SQUARE'.

Nixon never said that about JFK's theft of the election of 1960, because he was a patriot.

Every US state certified its election results in 2016. Every one. Because where there were problems, there were back up systems including paper ballots. Because the system is decentralized, multifarious and controlled by local officials it is robust. All the faults of the current chaos of voting in the United States are its strengths, protecting the integrity of the results.

All of this is admitted in the story, because even its authors know it to be the truth.

At 8.2 million after 32 contests, the popular vote for Trump alone with 16 states yet to vote is set to surpass 12 million.

A big victory for electricity from coal and for Laurence Tribe: Supremes stay EPA rule implementation shutting down 53 plants

WASHINGTON — In a major setback for President Obama’s climate change agenda, the Supreme Court on Tuesday temporarily blocked the administration’s effort to combat global warming by regulating emissions from coal-fired power plants. ... “We are thrilled that the Supreme Court realized the rule’s immediate impact and froze its implementation, protecting workers and saving countless dollars as our fight against its legality continues,” said Patrick Morrisey, the attorney general of West Virginia, which has led the 29-state legal challenge. ... In a second filing seeking a stay, coal companies and trade associations represented by Laurence H. Tribe, a law professor at Harvard, said the court should act to stop a “targeted attack on the coal industry” that will “artificially eliminate buyers of coal, forcing the coal industry to curtail production, idle operations, lay off workers and close mines.” ... Mr. Tribe added that the plan “will cause the closure of 53 coal-fired plants in 2016 and another three in 2018.”

Congress corrected itself in 1795 dropping "natural born citizens" of children born abroad to citizens

'The authors cite to the Naturalization Act of 1790 and ignore the fact that the Naturalization Act of 1795, with the lead of then-Rep. James Madison and with the approval of President George Washington, repealed it and specifically changed "shall be considered as natural born citizens" to "shall be considered as citizens of the United States."  This is even more a blatant omission given that they argue that the English naturalization statutes referred to persons born out of the King's dominion to British subject parents as "natural born subjects."  They fail to address this critical change made by our early Congress, critical because Article II, Section 1, Clause 5 provides that a “Citizen” of the United States was eligible to be President only if born before the adoption of the Constitution and that thereafter only a “natural born Citizen” was so eligible.'

TARP ends, but conservatives still don't realize it was just a sideshow

That TARP was just a sideshow was not known at the time in 2008, but it should be known by now.

Too bad conservatives haven't paid attention.

TARP assumed the role of the main actor on the stage of the financial panic as the liberal government of George W. Bush tried to show that it was capable of doing something to bring the panic of 2008 to an end. Bush at length signed the TARP legislation on October 3, 2008, at which point the stock markets promptly rewarded him by caving over the next three weeks, setting the stage for the final denouement by March 2009. Only Securities and Exchange Commission changes to mark-to-market accounting rules at that point stopped the cratering and put a floor under stock prices. Meanwhile behind the scenes the liberal government of Woodrow Wilson in the form of the Federal Reserve had already been hard at work for months frantically doing the real rescue.

Now that TARP is over, liberal political operatives are wont to characterize TARP as a success because it supposedly made a profit accruing to the government, and hence to The People, who are ever almighty in liberalism. They also say this to keep our eyes off the ball. "Conservatives" continue to take that bait and argue there was a loss to TARP, never examining themselves to see if they are in the larger truth. National Review's Matt Palumbo is just the latest example, here, quibbling over a few measly billions of dollar based on an argument from inflation to substantiate a loss to TARP.

It doesn't get much more pathetic than that.

TARP became the sideshow it always was once and for all when Bloomberg News, using the Freedom of Information Act, forced the Fed long after the fact in late 2010 and early 2011 to reveal the true scope of its bailout of the world in 2008-2009. Behind the scenes the rest of us had groped in the dark trying to fathom TARP's $700 billion bailout, when that turned out to be just a decimal point in the real bailout, the Fed's $7.7 trillion lending authority through the discount window and other programs.

"Conservatives" still haven't grasped this.

Over five million Americans lost their homes in the wake of the panic, almost 30 million ended up filing first time claims for unemployment in 2009 (85% more than did just last year), and almost eight years after the employment peak of 2007 full-time jobs still have not recovered, the most disgraceful record in the post-war.

The Federal Reserve bailed out hundreds upon hundreds of large banks and corporations not just in the United States but all across the globe by backstopping them with promises of huge sums if needed while regular Americans were simply left to fend for themselves:

$7.77 trillion -- The amount the Fed pledged to rescue the financial industry, according to Bloomberg research that examined announced, implied or actual upper limits on lending and guarantees. This number, which represents potential commitments, not money out the door, was first published in March 2009, when it peaked.

“One of the keys to understanding why we’ve avoided another Great Depression, so far, is to see how bold the Fed was in 2008 and 2009,” said Niall Ferguson, a Harvard University history professor. “That boldness consisted of a range of contingency commitments that backstopped the banking system. Just because they weren’t used doesn’t mean they weren’t important.”

Actual loans at rock bottom prices over time amounted to about half that, at $3.3 trillion, as can be appreciated here in just one of the lending programs of the Fed, the famous discount window. The low interest rates charged there, a sideshow in themselves, are thought to have benefited the banks at the same time by about $13 billion, according to Bloomberg, over what they would have had to pay at market rates.

That was simply the cherry on the gargantuan crony capitalism cake, an object, I am sure, of singular fascination for the likes of the Matt Palumbos of the world.

After 76 months, the jobs recession ends no thanks to Obama as the liberals declare victory and go home

That's after 6 years and 4 months for those of you in Rio Linda.

This [graph] shows the depth of the recent employment recession - worse than any other post-war recession - and the relatively slow recovery due to the lingering effects of the housing bust and financial crisis. Total employment is now 98 thousand above the pre-recession peak and at an all time high.  It is probably time to retire this graph - until the next recession.

Obama was first elected in month 12 of the jobs recession when its severity was still at -3.0% on this chart. Americans had no idea what was coming. Nearly 30 million Americans would go on in 2009 alone to file first time claims for unemployment compensation.

If Obama's election meant salvation from a looming crisis, businesses didn't think so. They proceeded out of fear of the most anti-capitalist president to be elected in the history of the country to cut their number one cost in order to survive what was coming. Arguably Obama's election made a severe downturn into the employment crisis that it became.

The longest and deepest jobs recession in the post-war is now over according to the seasonally adjusted figures published by the Bureau of Labor Statistics. At the very least the Columbia and Harvard educated Obama did nothing effectual to end it in a timely manner as all his predecessors had done, even George W. Bush by comparison. The reason? Your choices are a) incompetence and b) malice aforethought.

Bringing America down a notch or two seems to have been the guiding principle for every problem Obama has had to confront during his presidency, whether in domestic or foreign policy. When it comes to jobs, the average middle class family which lost a good $50,000 income to long term unemployment is now in the 6th year of reduced circumstances. Such a family is easily $250,000 behind when you combine the effects of reduced wages and retirement funding. Such equality with the poor isn't what the middle class had in mind, but it sure looks like what Obama did.

Penn State Alumni Newsletter In November 2007 Bragged That Global Warming Promoter Michael Mann Shared In The Nobel Peace Prize Awarded To The IPCC And Al Gore

And worse, the association puts Mann on the same level as a real Nobel winner like Paul Berg who was a named winner who shared the Prize for Chemistry with two others. Michael Mann cannot be said to have shared the Peace Prize with Al Gore and the IPCC, nor can any of the other 2000 members of the IPCC or however many there were be said to have shared it, either. To say this diminishes the achievement of named winners of prizes who may have won them alone or in company with other named individuals.

Five Penn State scientists, all members of the U.N. Intergovernmental Panel on Climate Change (IPCC), shared in the 2007 Nobel Peace Prize when the 2,000-member IPCC and former vice president Al Gore were recognized for their work on climate change issues.

The five Penn State scientists and IPCC members are: Richard Alley, Evan Pugh Professor of Geosciences; William Easterling, dean of the College of Earth and Mineral Sciences and professor of geography and earth system science; Klaus Keller, assistant professor of geosciences, Michael Mann, associate professor of meteorology; and Anne Thompson, professor of meteorology.

They join the select company of Paul Berg ’48, the only Penn State alumnus to win a Nobel Prize. The Nobel committee recognized Berg for his groundbreaking construction of the first recombinant-DNA molecule—a discovery that paved the way for scientists interested in understanding the interactions between the chemical structure of DNA and resultant biological structure, or function, of an organism.

Al Gore can claim to have won the Nobel Peace Prize, and the IPCC can claim to, but none of the individual panel members can claim to have shared in the winning of that prize. Michael Mann did not win the 2007 Nobel Prize for Peace. Mann has had to retract his own claims to the prize as reported here:

Disgraced Penn State University (PSU) climatologist, Michael Mann, concedes defeat in his bogus claims to be a Nobel Peace Prize winner. Mann’s employer this weekend began the shameful task of divesting itself of all inflated claims  on university websites and official documentation that Mann was ever a Peace Prize recipient with Al Gore and the UN’s Intergovernmental Panel on Climate Change.

Nat Hentoff Says Obama Wasn't Fully Qualified To Teach Constitutional Law At The University of Chicago

Here, but that's just for starters:

Hentoff called this the worst state the country has ever been in, “Even worse than Woodrow Wilson’s regime, when people could be arrested for speaking German.” Compounding the problem he says, is the digital age, which has allowed the president to engage in unprecedented domestic spying with the apparatus of the National Security Agency. WND asked if Obama really posed such a threat, considering he was a professor of constitutional law. “People forget, he taught a course that he was not fully qualified to teach. But nobody seemed to care,” Hentoff observed.

He also pointed out that Obama was the only editor of the Harvard Law Review to never publish an article, something that went virtually unnoticed when voters considered his qualifications. “See, that was a case of affirmative-action and people feeling, ‘Hey we ought to do something important, symbolically, and here’s a black guy, and he’s articulate, so we’re gonna do this.’”

Hentoff mentioned that former U.S. Supreme Court Justice William O. Douglas, the man Time Magazine once called “the most doctrinaire and committed civil libertarian ever to sit on the court,” once personally lectured him that “Affirmative-action on a racial basis is a total violation of the 14th Amendment, no doubt about it.” And, referring to Obama’s presidency, the journalist said, “That’s what that kind of affirmative-action did for us.”

He told WND that he firmly believed the president does not care about due process, the separation of powers, the concept of a self-governing republic or many other basic American ideals. And that’s why, he said, “What Obama is doing now is about as un-American as you can get.” Hentoff wanted to make sure no one thought he was engaging in hyperbole. He said it was literally true that Obama is “the most un-American president we’ve ever had.” And just to make sure everybody heard him, he added, “I hope the FBI got all of that.”

Davis was 21, not 19, when she was divorced. She lived only a few months in the family mobile home while separated from her husband before moving into an apartment with her daughter.

A single mother working two jobs, she met Jeff Davis, a lawyer 13 years older than her, married him and had a second daughter. He paid for her last two years at Texas Christian University and her time at Harvard Law School, and kept their two daughters while she was in Boston. When they divorced in 2005, he was granted parental custody, and the girls stayed with him. Wendy Davis was directed to pay child support.

In an extensive interview last week, Davis acknowledged some chronological errors and incomplete details in what she and her aides have said about her life. ...

Davis defended the accuracy of her overall account as a young single mother who escaped poverty, earned an education and built a successful legal and political career through hard work and determination. ...

“I had a baby. I got divorced by the time I was 19 years old,” she testified in a recent federal lawsuit over redistricting. “After I got divorced, I lived in a mobile home park in southeast Fort Worth.” ...

Jeff Davis said ... around the time the final payment on their Harvard Law School loan was due. “It was ironic,” he said. “I made the last payment, and it was the next day she left.”
